§ 1 Organizer
Open Beatz Festival GmbH
An der Römerstraße 18
89331 Burgau
E-Mail: [email protected]
Commercial Register: Amtsgericht Memmingen – HRB 17192
(hereinafter referred to as the “Organizer”)
§ 2 Scope / Contractual Partner
- Open Beatz Festival GmbH, represented by the managing directors Florian Gebauer and Tobias Hagel, An der Römerstraße 18, 89331 Burgau (hereinafter referred to as the “Organizer”), offers festivals (hereinafter referred to as “Open Beatz”) on the designated site at Puschendorfer Str. 2, Herzogenaurach, Bavaria. The festival site includes the infield, the camping area, and the parking lot, access to which is only granted with a valid ticket (hereinafter referred to as “Ticket”).
- These General Terms and Conditions (hereinafter referred to as “GTC”) apply between the purchaser of a Ticket (hereinafter referred to as “Visitor” or “Ticket Holder”) and the Organizer. If the GTC of the Organizer’s contractual partners are applied and conflict with the Organizer’s GTC, the Organizer’s GTC shall take precedence. By purchasing a Ticket, the Visitor enters into an event contract and acquires the right to attend the event. By booking a parking space, the Visitor enters into a rental agreement for a parking spot. By booking a locker, the Visitor enters into a rental agreement for a locker (hereinafter referred to as “Locker”).
- In addition to the obligations arising from these GTC, the Visitor undertakes to comply with the additional rules of conduct for the various areas of Open Beatz, in particular the infield, the camping area, and the parking lot.
- Contractual relationships are established exclusively between the Organizer and the Visitor who purchases the Ticket.
§ 3 Scope, Subject Matter, and Conclusion of the Respective Contract
- The following conditions exclusively govern the contractual relationship between the Visitor and the Organizer. The Organizer points out that it acts as an entrepreneur within the meaning of § 14 of the German Civil Code (BGB), i.e., in the exercise of its commercial or independent professional activity.
- These General Terms and Conditions (GTC) apply exclusively. Conflicting or deviating terms and conditions of the Visitor shall not be recognized unless the Organizer has expressly agreed to them on a case-by-case basis.
- They apply both to consumers and to entrepreneurs. For the purposes of these GTC, a consumer is any natural person who places the order for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is a natural or legal person, or a legally capable partnership, who acts when placing the order in the exercise of their commercial or independent professional activity.
- The Organizer only enters into contracts with consumers who are at least 16 years old.
- The primary subject of the respective contract is the purchase of a Ticket, by which the parties conclude an event contract and the Visitor acquires the right to attend the event. In addition, the Visitor may book further services. By booking a parking space or camping space, the Visitor concludes a rental agreement for a vehicle or camping space. By booking a locker, the Visitor concludes a rental agreement for a locker (hereinafter referred to as “Locker”). The subject of the respective contract may also include the sale of additional items by the Organizer to the Visitor.
- The supervision, monitoring, or safekeeping of the parked vehicle, the provision of insurance coverage, or any other activity that goes beyond the provision of the parking space is not part of the contract. Accordingly, the Organizer assumes no custodial responsibilities.
- During the rental period, ordinary termination of the rental agreement is excluded. The rental agreement ends at the end of the rental period unless it is terminated without notice beforehand. A refund of the rental fee in the event that the customer does not use the rented parking or camping space is only possible in accordance with the applicable statutory provisions (currently: § 537 BGB) and is otherwise excluded.
- Special provisions apply to the booking and use of the parking lot, the booking of a camping space and use of the camping area, as well as the booking and use of lockers. These special provisions are attached to these GTC.
- The Visitor can place an order for Tickets, additional items, the booking of a parking space, camping space, Locker, or other items via the Organizer’s website. The offer for the conclusion of a contract is made by the Visitor as soon as they click the “Pay Now” button (or a button with a similar wording). Acceptance of the contract between the Visitor and the Organizer occurs (i) in the case of prepayment by providing the bank transfer details for the outstanding payment, and (ii) for all other payment methods by allocation and sending of the Ticket number or Ticket to the participant. Furthermore, sending access to a personal MyTicket portal, which is visible to the participant, always constitutes a contract confirmation. If the Visitor does not receive such a confirmation in due time, they are no longer bound to their order.
- Upon receipt of full payment by the Organizer, the Visitor receives the Tickets sent to the email address provided. No additional Tickets will be sent by post or fax.
- The contract text and the General Terms and Conditions will be sent to the Visitor by email after the order. Furthermore, Visitors who have created a customer account can access their respective orders at any time after the conclusion of the contract via their account.
- The contract is concluded exclusively in German. German law shall apply insofar as the Visitor is a merchant.
- All prices are quoted in gross Euros.
§ 4 Execution of the Purchase Contract
- The purchase of Tickets takes place via the ticket shop of TicketPAY Europe GmbH (hereinafter referred to as “TicketPAY”). After selecting a Ticket on the Organizer’s website https://openbeatz.de/tickets , the Visitor will be redirected to the ticket shop at https://shop.ticketpay.de/UFY5SWQC . The General Terms and Conditions of TicketPAY also apply in addition, which you can find here.
- TicketPAY acts in the sale of Tickets as a legal representative and on behalf of and for the account of the Organizer. The contract for the purchase of the Ticket is concluded exclusively between the Organizer and the Visitor.
- By clicking the “Order with obligation to pay” button or any other button corresponding to the requirements of § 312j (3) BGB, the Visitor submits a binding offer to conclude the contract. The Organizer accepts this offer in the case of prepayment by sending the booking confirmation via email and in the case of all other payment methods by immediately sending the print@home Tickets via email.
§ 5 Obligations of the Visitor
- The Visitor is solely responsible for the safekeeping and carrying of the Tickets for the event.
- Tickets or other services that can only be purchased in a personalized manner entitle only the respective holder of the Ticket or booked additional item to attend the event or use the service. Any re-personalization is subject to the applicable General Terms and Conditions of TicketPAY Europe GmbH.
- When using discounted Tickets, the Visitor is obliged to provide the corresponding proof unprompted at the event’s access controls. If the Visitor fails to do so, the Organizer has the right, after setting a reasonable deadline for compliance with the proof requirement, to withdraw from the contract. If it turns out that the Visitor is not entitled to the respective Ticket type, the Organizer is legally entitled to contest the contract.
- The Visitor is obliged to use the services provided/to be provided by the Organizer only for the contractually agreed purposes. In particular, the Visitor is only entitled to use the Tickets for private purposes. Any commercial resale of purchased Tickets or use as a prize in a contest, sweepstakes, or for other promotional purposes is prohibited without prior consent from the Organizer. Private resale is only permitted via the TicketPAY platform and is subject to the applicable General Terms and Conditions of TicketPAY Europe GmbH.
- Altering the Ticket (e.g., printing on it, modifying it, or any other form of tampering) for the purpose of deception or disadvantaging others is prohibited.
- Any Visitor who transfers Tickets in violation of the provisions of § 5 clauses 4 or tampers with Tickets as described in § 5 clause 5 is obliged to pay the Organizer a reasonable contractual penalty, determined at the Organizer’s discretion and subject to judicial review, of up to €2,500.00 per unlawfully offered or tampered Ticket or attendance right. The Organizer reserves the right to claim higher damages, offsetting the contractual penalty. In such cases, the Organizer is also entitled to confiscate the affected Ticket or revoke the attendance right.
- The Visitor must ensure that their actions in connection with the event do not violate statutory provisions and/or the rights of third parties. In particular, the Visitor is obliged to verify the legal permissibility of any actions and to act in compliance with the law.
- If third parties assert claims against the Organizer under the preceding clauses, the Organizer will inform the Visitor immediately. The Visitor undertakes to indemnify the Organizer against any liability to third parties, to support the Organizer in legal defense, and to bear the costs of reasonable legal defense, provided the Organizer is not partly at fault. In such cases, the indemnification is to be reduced by the proportion of contributory fault.
§ 6 Changes, Cancellation, and Termination by the Organizer
- The Organizer has no influence over the design, duration, or content of individual performances and therefore assumes no liability to the Visitor in this regard.
- The Ticket entitles its holder to attend the festival on the premises. The Organizer has the right to make short-term changes to the schedule, content, and location of the event. The Organizer will, as far as possible, provide equivalent replacements. This does not give the Visitor the right to withdraw from the contract and/or cancel their Tickets, as long as the overall character of Open Beatz is maintained.
- Delays and rescheduling of individual program items must be tolerated by the Visitor to a reasonable extent.
- Cancellations or changes will be announced by the Organizer as early as possible and may also occur after the start of the festival for an important reason. The Organizer will endeavor to announce program changes immediately on its website www.openbeatz.de, on the relevant social media channels, and in the festival app.
- The Organizer reserves the right to reschedule or cancel the event locally and/or in time for an important reason. In this case, any refund is limited to the face value of the Ticket and only up to the date of the event. Further claims are excluded, except insofar as any exclusion of liability under these General Terms and Conditions does not apply.
- The Organizer is released from its performance obligations in cases of force majeure. Force majeure includes all unforeseen events as well as events whose impact on contract performance is not attributable to either party. Such events include, in particular, epidemics, pandemics, lawful industrial actions, including in third-party companies, and official measures. In the event of cancellation by the Organizer, already paid fees will be refunded; further claims are excluded unless liability limitations/exclusions under § 8 of this contract apply.
- Open Beatz generally takes place regardless of weather conditions. However, if weather conditions pose a danger to the life, limb, or health of Visitors, artists, and/or staff, the Organizer may immediately terminate Open Beatz. If a service to be provided by the Organizer becomes impossible or delayed due to weather conditions, official orders, judicial decisions, or other unforeseeable and non-attributable circumstances (e.g., industrial actions, operational disruptions, transport obstacles, official measures – also affecting the Organizer’s contractual partners), the Organizer is entitled to cancel the event.
- Additionally, the current notices and the instructions of the on-site security personnel apply.
§ 7 Rights to One’s Own Image / Photo, Video, and Audio Recordings
See Data Privacy.
§ 8 Liability
- The Organizer is not liable for damaged, lost, stolen, or otherwise missing items.
- Any claim for damages arising from culpable breach of duty or for other legal reasons by a Visitor is limited in favor of the Organizer as follows:
a. In full for gross negligence or intent (§ 309 No. 7b BGB) by the Organizer, its organs, or executive employees;
b. In principle, for any culpable breach of essential contractual obligations, whereby essential contractual obligations are those whose violation endangers the achievement of the contract purpose;
c. Outside of such obligations, in principle only for gross negligence (§ 309 No. 7b BGB) of vicarious agents. In cases b and c, the Organizer’s liability is limited to foreseeable, contract-typical damages. - If parking spaces, camping passes, lockers, or other additional items are booked, the provisions of rental law may additionally apply. In rental relationships, the Organizer’s strict liability for defects already existing at the time of contract conclusion is excluded.
- In the event of statutory warranty claims, liability for defects is excluded for defects caused by external influences not attributable to the Organizer or by improper use by the Visitor.
- The Organizer is generally not liable for minor negligence, nor for damaged, lost, stolen, or otherwise missing items.
- Use of the parking lot is at the Visitor’s own risk.
- The Visitor and accompanying persons undertake to treat the parking lot, camping space, buildings, facilities, inventory, etc. of the camping area with care.
- The Organizer expressly points out that irregularities, damages, or losses due to natural causes (e.g., tree fruits, insects, animals, branches, etc.) may occur; the Organizer’s liability for such damages is excluded under the following liability regulations.
- The Visitor is liable for all damages caused by themselves or their accompanying persons in the parking lot, camping area, or toward other Visitors. Damages culpably caused by the Visitor or their accompanying persons during the stay must be reported to the Organizer immediately.
- Obvious damages caused by the Organizer that become known to the Visitor before leaving the parking lot must be reported immediately, and the Organizer must be given the opportunity to inspect the damage. If this is exceptionally not possible or reasonable for the Visitor, the notice must be submitted in text form to the Organizer at the address stated in these GTC. Personnel do not include farmers assisting with weather-related towing measures.
- The Organizer is not liable for the loss of personal valuables stored in the locker. Additionally, the Organizer is not liable for the loss of items stored in the locker unless the Visitor is grossly negligent.
- The Visitor shall assist the Organizer in identifying and remedying defects and shall provide immediate access to documents revealing the circumstances of the defect.
- The Organizer is fully liable for damages caused intentionally or through gross negligence, for fraudulently concealed defects, for guarantees of quality, for claims under the Product Liability Act, and for injury to life, body, or health. For other damages, liability exists only if an obligation is breached whose fulfillment makes proper performance of the contract possible in the first place and on which the Visitor may regularly rely (cardinal obligations), or if the risk is solely within the Organizer’s control.
- The above liability limitations also apply to the Organizer’s vicarious agents.
- Otherwise, liability is excluded.
§ 9 Access to the Festival
- Access to the festival is only granted to Visitors who hold a valid Ticket and have reached the age of 16. For Visitors aged 16 or 17, a supervising adult is mandatory. At first entry (check-in), the Ticket and a valid official ID must be presented. The Ticket will be exchanged for a festival wristband. The wristband must be worn at all times while on the festival grounds and may not be removed or transferred to others.
- Visitors with a festival ticket including a camping pass may move freely between the camping area and the infield during the entire festival weekend. Visitors without a camping pass, i.e., those not staying on the camping site (hotel guests, day guests, etc.), do not have access to the camping area. However, they may enter and exit the infield as often as they wish during opening hours, in accordance with their ticket category.
- The Organizer reserves the right to refuse access to the infield or camping area for important reasons. Important reasons include, but are not limited to, possession of prohibited items according to § 10, obvious intoxication, apparent drug influence, or the use of homophobic, sexist, racist, or otherwise offensive statements. Entry will also be denied in cases of violation of youth protection regulations (§ 12). If there is an important reason for denying entry, the Visitor’s Ticket becomes invalid and the Ticket price will not be refunded.
- The Organizer reserves the right to remove Visitors found on the infield or camping area without proper authorization from the entire festival grounds. No claim for a refund of the entrance fee exists.
- Unlocked or damaged festival wristbands lose their validity and must be exchanged immediately at the service counter.

5. If any of the aforementioned important reasons apply and the Visitor is removed from the event location, the ticket becomes invalid; the admission price will not be refunded. A Visitor who culpably violates these Terms and Conditions, the festival regulations, the camping regulations, or the parking regulations is obligated to compensate the Organizer for any damage caused to the Organizer as a result.
§ 12 Youth Protection
The provisions of the Youth Protection Act in public spaces apply to the entire festival grounds.
§ 13 Health Risks from Sound Levels
§ 13 Gesundheits-beeinträchtigung durch Lautstärke
The Visitor is aware that at Open Beatz, particularly in front of the stages, there is a high level of sound, and there is a risk of potential health damage, especially hearing damage. The Organizer ensures, through suitable technical equipment and volume limitation, that the Visitor does not suffer harm from the sound level of the performances. Regardless, it is strongly recommended to use earplugs, particularly when staying near speaker boxes, and to choose a spot in front of the respective stages that is conducive to the Visitor's individual hearing preferences.

The professional collection of deposit bottles is strictly prohibited on the entire festival grounds and will be prosecuted criminally if there is reasonable suspicion of a criminal offense.

- The Visitor is also aware that extreme weather conditions may cause difficulties when arriving at or leaving the parking spaces. No guarantee is given for trouble-free access to the areas. Furthermore, the Visitor acknowledges that the parking areas have limited lighting at night and in darkness and is responsible for informing their fellow passengers accordingly.

- If the Visitor is not assigned a specific parking space by the Organizer or its staff, they may choose a space among the free, non-reserved parking areas. The Visitor must observe the guidelines set by the parking facilities.
- The Visitor must park their vehicle in a marked space in such a way that entering and exiting neighboring vehicles is possible at all times without obstruction. If this is not possible, the Visitor must choose a different parking space.
- If the Visitor fails to comply with this requirement, the Organizer is entitled, at the Visitor’s expense, to move the improperly parked vehicle into the correct position, transfer it to another available space, or – if no other remedy is possible – remove it from the parking lot.
- The parking lot and its facilities must be used carefully and properly. Any damages will be repaired at the Visitor’s expense. Parking vehicles with leaking fuel tanks or fuel lines is strictly prohibited.
- When entering and exiting the parking lot, the Visitor must exercise due care, even if employees or representatives of the Organizer are providing assistance or directions.

- Only vehicles with a maximum permissible total weight of up to 3.5 tons, including trailers, may be parked in the parking areas.
§ 4 Security Personnel
The security personnel is responsible for guidance and checking access rights, not for vehicle surveillance.
§ 5 Applicability of Road Traffic Regulations (StVO) and Other Restrictions

b. Storing any items;
c. Unnecessarily revving or testing engines;
d. Parking vehicles with leaking fuel tanks or carburetors;
e. Parking non-approved vehicles;
f. Cleaning vehicles or performing repairs. - The cleaning of the parking area is carried out by the Organizer; however, any soiling caused by the Visitor must be removed by the Visitor without delay. If this is not done, the Organizer is entitled to remove such soiling at the Visitor’s expense.
- The Organizer’s staff are authorized and obligated to ensure compliance with the parking regulations. Their instructions must be followed.
§ 6 Removal and Disposal of Vehicles
- The Organizer may have the vehicle towed from the parking area at the Visitor’s expense and risk if:
a. The agreed parking time is exceeded without a special arrangement;
b. The vehicle contaminates the parking lot or threatens its operation due to leaking fuel tanks, carburetors, or other defects;
c. The vehicle is not registered or is impounded by the police during the parking period. - All costs incurred in this context shall be borne by the Visitor.
III. Camping Area Provisions
§ 1 Camping Regulations
The Visitor acknowledges the camping area regulations and agrees to abide by them.
§ 2 Arrival and Departure Times
- A campsite booked by the Visitor on the camping grounds will be available to the Visitor from 10:00 a.m. on the day of arrival. The entire camping area will not be opened at once but rather section by section as needed.
- Unauthorized camping (“wild camping”) is prohibited and will be prosecuted by the authorities.
- Environmental protection and the principles of waste reduction and proper waste disposal must be observed.
- The unauthorized creation of fire pits on camping areas or parking lots is prohibited due to the resulting fire hazard.
- The campsite must be vacated and left clean by 3:00 p.m. on the day of departure. If this deadline is exceeded, an additional fee may be charged. However, proper clearance of the site remains the Visitor’s primary obligation under the contract.
§ 3 Stay/Visitors
- The camping area may only be used by the number of persons registered. Visitors must be registered before entering the camping grounds.
- Each Visitor is permitted to occupy the campsite only with standard camping equipment. Additional camping equipment requires the Organizer’s approval and must be registered in advance.
§ 4 Environmental Protection
§ 4 Environmental Protection
- The environment and nature must be protected. Consideration for flora and fauna is of utmost importance. Therefore, generators may only be brought if they meet the specified conditions (see Info Page).
- It is prohibited to dig trenches (e.g., for rainwater drainage) or other holes (e.g., for cooling) on the camping grounds.
- Gas cooking devices must be in perfect technical condition and comply with German DIN standards. Only gas cartridges (pierceable and valve cartridges) with a maximum filling weight of 450g are permitted. Open fires and campfires are not allowed.
- Barbecuing is permitted with small grills. In case of storms or similar weather conditions, grilling may be prohibited for safety reasons. In the event of a fire, the security staff must be notified immediately, even if the fire has already been extinguished. To avoid accidents, the use of spirits, gasoline, or other flammable liquids is prohibited. Only commercially available charcoal lighters may be used according to the manufacturer’s instructions. The grill must never be left burning or glowing unattended. It is strictly forbidden to dump glowing charcoal onto the grass.
- During the event, waste must be disposed of at the designated waste collection points in the provided bins and containers. Additional garbage bags will be distributed free of charge to help maintain cleanliness.
§ 5 Unauthorized Access
Persons found on the enclosed camping area without authorization will be reported for fraud (§ 265a StGB) and trespassing (§ 123 StGB), provided there is a reasonable suspicion of a criminal offense.
IV. Special Provisions for the Use of Lockers ("Locker")
§ 1 Locker Usage
- The lockers may only be used during the festival’s opening hours. Use outside of these hours is not permitted.
- Lockers are secured with either a code or a key. The Visitor will receive the code/key from the locker support staff.
- The Organizer is entitled to open a locker in cases of imminent danger. Imminent danger particularly includes the justified suspicion that prohibited items, as defined in § 10 of these Terms and Conditions, are stored in the locker on the festival grounds. In such cases, the Organizer will, where possible, involve the police.
- After the agreed rental period has expired, the locker must be completely cleared.
- Items remaining in a locker after the end of the agreed rental period will be treated as lost property. They will be inventoried by the Organizer and handed over to the local lost and found office of the City of Herzogenaurach, where the Visitor may collect them in accordance with the general regulations.
