I. General Provisions

Preamble
Open Beatz Festival GmbH, represented by managing directors Florian Gebauer and Tobias Hagel, located at An der Römerstraße 18, 89331 Burgau (hereinafter referred to as the "Organizer"), organizes festivals (hereinafter referred to as "Open Beatz") on the designated festival grounds at Puschendorfer Str. 2, Herzogenaurach, Bavaria. The festival grounds include all areas of Open Beatz, which can only be accessed with a valid ticket (hereinafter referred to as the "Ticket"), as well as the camping area and parking zones (hereinafter collectively referred to as the "Festival Grounds").
§ 1 Scope, Subject, and Conclusion of the Contract
1. These terms and conditions conclusively regulate the contractual relationship between the purchaser of a ticket or other service (hereinafter referred to as the "Visitor") and the Organizer. The Organizer points out that they act as an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), i.e., in the exercise of their commercial or independent professional activity.
2. These General Terms and Conditions apply exclusively. Conflicting or deviating terms and conditions of the Visitor will not be recognized unless the Organizer has expressly agreed to them in individual cases.
3. These terms apply to both consumers and businesses. A consumer within the meaning of these Terms and Conditions is any natural person who places an order for purposes that are predominantly outside their trade, business, or professional activity. A business within the meaning of these Terms and Conditions is any natural or legal person or legally capable partnership that places an order in the course of their trade, business, or professional activity.
4. The Organizer only enters into contracts with consumers who are at least 16 years old.
5. The primary subject of the contract is the purchase of a ticket, through which the parties enter into an event contract, granting the Visitor the right to attend the event. Additionally, the Visitor may book further services. By booking a parking or camping space, the Visitor enters into a rental agreement for a vehicle or camping spot. By booking a locker, the Visitor enters into a rental agreement for a locker (hereinafter referred to as "Locker"). The subject of the contract may also include the sale of additional items by the Organizer to the Visitor.
6. The guarding, monitoring, or safekeeping of the parked vehicle, the provision of insurance coverage, or any other activity beyond the provision of the parking space is not part of the contract. Accordingly, the Organizer assumes no custodial duties.
7. Termination of the rental agreement during the rental period is excluded. The rental agreement ends upon the expiration of the rental period unless it is terminated prematurely without notice. A refund of the rental fee in the event that the customer does not use the rented parking or camping space is only possible in accordance with the applicable legal provisions (currently Section 537 of the German Civil Code (BGB)) and is otherwise excluded.
8. Special provisions apply to the booking and use of parking spaces, the booking of camping spaces and use of the camping area, as well as the booking and use of lockers ("Lockers"). These special provisions can be found in the appendix to these General Terms and Conditions (GTC).
9. The Visitor can place an order for tickets, additional items, parking spaces, camping spaces, lockers, or other items via the Organizer's website. The Visitor makes an offer to enter into a contract when they click the "Pay Now" button (or a similarly labeled button). The contract between the Visitor and the Organizer is concluded (i) in the case of prepayment, by displaying the transfer details for the pending payment, and (ii) for all other payment methods, by assigning and sending the ticket number or the ticket to the participant. Additionally, the visible provision of access to a personal MyTicket portal always constitutes confirmation of the contract. If the Visitor does not receive such confirmation in a timely manner, they are no longer bound by their order.
10. After the full payment has been received by the Organizer, the Visitor will receive the tickets via the email address they provided. The Visitor will not receive any additional tickets by post or fax.
11. The contract text and the General Terms and Conditions will be sent to the Visitor via email after the order is placed. Additionally, Visitors who have created a customer account can access their orders at any time after the contract is concluded through their customer account.
12. The contract is concluded exclusively in German. German law applies insofar as the Visitor is a merchant.
13. All price information is stated as gross prices in euros.
§ 2 Execution of the Purchase Contract
1. Upon conclusion of the contract, payment of the purchase price is due immediately. The Visitor has the option to choose between different payment methods.
2. In the case of chargebacks, these additional costs will be charged to the Visitor.
3. If the transaction qualifies as a mutual commercial transaction under the terms of the Commercial Code, the Visitor must inspect the delivered goods without delay after receipt. This particularly applies to verifying the completeness and functionality of the goods. Any defects identified during this inspection or that are readily apparent must be reported to the seller immediately, including a detailed description of the defects. Failure to notify the seller will result in the goods being deemed accepted, unless the defect was not detectable during the inspection.
4. Defects in the goods that could not be detected during the proper inspection pursuant to paragraph 3 must be reported to the seller immediately upon discovery, provided the transaction qualifies as a mutual commercial transaction. Otherwise, the goods will also be deemed accepted with regard to such defects.
§ 3 Obligations of the Visitor
1. The Visitor is responsible for the safekeeping and carrying of the tickets to the event.
2. Tickets or other services that can only be purchased as personalized are valid solely for the respective holder of the ticket or the booked additional item for participation in the event or usage. Personalization changes are subject to the applicable General Terms and Conditions of TicketPAY Europe GmbH.
3. When using discounted tickets, the Visitor is obligated to present the corresponding proof at the event access controls without being asked. If the Visitor fails to do so, the Organizer reserves the right to withdraw from the contract after setting a reasonable deadline to fulfill the proof requirement. If it is determined that the Visitor is not entitled to the specific ticket type, it is noted that the Organizer is legally entitled to contest the contract.
4. The Visitor is obligated to use the services provided or to be provided by the Organizer solely for the purposes agreed upon in the contract. In particular, the Visitor is only permitted to use the tickets for private purposes. Any commercial resale of the purchased tickets or their use as prizes for contests, sweepstakes, or other promotional purposes is prohibited without prior consent from the Organizer. Private resale is only permitted through the TicketPAY platform and is subject to the applicable General Terms and Conditions of TicketPAY Europe GmbH.
5. Altering the ticket (e.g., printing on it, modifying it, or any other form of alteration) for the purpose of deception or disadvantaging others is prohibited.
6. Any Visitor who transfers tickets in violation of the provisions of § 3 Nos. 4 and 5 or alters tickets as described in § 3 No. 5 is obligated to pay the Organizer an appropriate contractual penalty of up to €2,500.00 per improperly offered or altered ticket or attendance right. The exact amount will be determined by the Organizer at their reasonable discretion and is subject to judicial review. The Organizer reserves the right to claim further damages, with the contractual penalty credited against such claims. Additionally, in such cases, the Organizer is entitled to confiscate the affected ticket or revoke the attendance right.
7. The Visitor must ensure that their actions in connection with the event do not violate legal regulations and/or the rights of third parties. In particular, the Visitor is obligated to verify the legal permissibility of any actions or activities themselves and to act in compliance with the law.
8. If third parties make claims against the Organizer based on the preceding clauses, the Organizer will inform the Visitor immediately. The Visitor agrees to indemnify the Organizer from any liability towards third parties, assist in the legal defense, and cover the costs of reasonable legal defense, provided that the Organizer is not at fault. In such cases, the indemnification will be reduced by the proportionate share of fault attributable to the Organizer.
§ 4 Changes, Cancellation, and Termination by the Organizer
1. The Organizer has no influence over the design, duration, or content of individual performances and therefore assumes no liability towards the Visitor for these aspects.
2. The ticket grants access to a variety of concerts and accompanying events on the festival grounds. The Organizer has the right to make last-minute changes to the schedule, content, and location of the respective events. The Organizer will, as far as possible, provide equivalent alternatives. This does not entitle the Visitor to withdraw from or cancel their tickets, as long as the overall character of Open Beatz remains intact.
3. Delays and rescheduling of individual program items must be accepted by the Visitor insofar as they are reasonable.
4. Cancellations or changes will be announced by the Organizer as soon as possible and may occur even after the festival has started for important reasons. The Organizer will try to immediately announce any program changes on its website at www.openbeatz.de as well as on the relevant social media channels. Changes during the festival will be communicated by the Organizer through the festival app and social media channels.
5. The Organizer reserves the right to relocate or cancel the event for important reasons, either in terms of location and/or date. In such cases, a refund claim is limited to the face value of the ticket and only up to the event date. Further claims are excluded unless the limitation or exclusion of liability under these General Terms and Conditions applies.
6. The Organizer is relieved from the obligation to perform in cases of force majeure. Force majeure includes all unforeseen events as well as those events whose effects on the fulfillment of the contract are not attributable to either party. These events specifically include epidemics, pandemics, lawful labor strikes, including in third-party companies, and government measures. In the event of cancellation by the Organizer, any already paid fees will be refunded; further claims are excluded unless the limitation or exclusion of liability under § 6 of this contract applies.
7. Open Beatz will generally take place in any weather conditions. However, if weather conditions pose a danger to the life, health, or safety of the visitors, artists, and/or staff, the Organizer may cancel Open Beatz immediately. If, due to weather conditions or a government order, court decision, or other unforeseen and unavoidable circumstances, a service to be provided by the Organizer becomes impossible or delayed (e.g., labor disputes, operational disruptions, transportation obstacles, government measures – including those affecting the Organizer's contractual partners), the Organizer is entitled to cancel the event.
8. Additionally, the current notices and the instructions of the security staff on-site apply.
§ 5 Photos and Recordings
We would like to inform you that audio and video recordings will be made by the Organizer and third parties commissioned by them before and during the entire event. These recordings may be published, distributed, and shared by the Organizer on the internet, in print media, and other media, insofar as this is permissible under the provisions of the GDPR and the German Copyright Act (KunstUrhG).
§ 6 Liability
1. The Visitor is entitled to statutory warranty rights for any defects, unless otherwise specified in these Terms and Conditions. For consumers, the statutory warranty rights are not limited by § 6 No. 2 of these Terms and Conditions.
2.If the Visitor is a business, the warranty period for rights under § 437 No. 1 and No. 3 of the German Civil Code (BGB) for new items is one year from the statutory commencement of the limitation period, deviating from § 438 para. 1 No. 3 BGB. For consumers, the statutory warranty period of two years applies in the case of § 438 para. 1 No. 3 BGB.
3. If parking spaces, camping passes, lockers, or other additional items are booked, the application of rental contract law may apply additionally. In rental agreements, the Organizer’s liability for damages, which were already present at the time of contract conclusion, is excluded regardless of fault.
4. In the event of a case of statutory warranty, liability for defects is excluded for defects caused by external influences not attributable to the Organizer, or by improper use by the Visitor.
5.The Organizer is generally not liable for damages caused by slight negligence, as well as for damaged, lost, stolen, or otherwise missing items.
6. The use of the parking lot is at the Visitor's own risk.
7. The Visitor and their accompanying persons agree to treat the parking lot, the camping space, as well as buildings, facilities, inventory, etc., on the camping grounds with care.
8. The Organizer expressly points out that natural irregularities, damages, or losses (e.g., fruits from trees, insects, animals, branches, etc.) may occur. The Organizer’s liability for such damages is excluded, taking into account the following liability provisions.
9. The Visitor is liable for any damage caused by themselves or their accompanying persons on the parking lot, camping grounds, or to other visitors. Any damage caused during the stay by the Visitor or their accompanying persons must be reported to the Organizer immediately.
10. Obvious damages caused by the Organizer, which become known to the Visitor before leaving the parking lot, must be reported to the Organizer immediately, and the Organizer must be given the opportunity to investigate the damage. If it is exceptionally not possible or reasonable for the Visitor to do so, the report must be made in writing to the Organizer at the address provided in these Terms and Conditions. Personnel does not include farmers who assist in towing measures due to weather conditions.
11. The Organizer is not liable for the loss of personal valuables stored in the locker. Additionally, the Organizer is not liable for the loss of items stored in the locker if the Visitor is at fault due to gross negligence.
12. The Visitor will assist the Organizer in identifying and rectifying defects and will immediately provide access to the documents that detail the circumstances surrounding the occurrence of the defect.
13. The Organizer is fully liable for damages caused intentionally or by gross negligence, for fraudulent concealment of defects, for the assumption of a warranty for the condition of goods, for claims under the Product Liability Act, and for violations of life, body, or health. For other damages, the Organizer is only liable if a duty is violated, the fulfillment of which is essential for the proper execution of the contract and upon which the Visitor can regularly rely (cardinal duties), or if it involves a risk that is solely under the Organizer's control. The above liability limitations also apply to the Organizer's agents.
14. The above liability provisions also apply to the Organizer's agents.
15. Otherwise, liability is excluded.
§ 7 Access to the Festival Grounds
1. Access to the festival grounds is only granted to visitors who have a valid ticket and are at least 16 years old. Visitors aged 16 or 17 must be accompanied by a guardian. Upon the first entry (check-in to the festival grounds/campsite), the ticket and a valid ID must be presented. The ticket will be exchanged for a festival wristband. The festival wristband must be worn throughout the entire stay on the festival grounds and may not be removed or transferred.
2. Visitors with a "Weekend Ticket & Camping" or "Weekend Ticket VIP & Camping" can move freely between the campsite, parking lot, and festival grounds at any time during the event weekend. All visitors who do not stay at the campsite (hotel guests, day visitors, etc.) are only allowed to enter and exit the festival grounds once per day. Re-entry on the same festival day is unfortunately not possible for safety reasons.
3. The Organizer reserves the right to refuse visitors entry to the festival grounds for an important reason. An important reason includes, but is not limited to, bringing prohibited items as defined in § 8, being in an obviously intoxicated state, being under the influence of drugs, or making homophobic, sexist, racist, or dehumanizing statements. Infringements of youth protection laws will also result in refusal of entry (§ 10). If there is an important reason for refusing entry, the visitor's ticket becomes invalid, and the ticket price will not be refunded.
4. The Organizer reserves the right to remove visitors found on the festival grounds without proper authorization from the entire festival area. There is no entitlement to a refund of the admission fee.
5. Unfastened or damaged festival wristbands lose their validity and must be exchanged immediately at the service desk.
§ 8 Prohibited Items/Entry Control

1. Dangerous and/or hazardous and/or prohibited items are not allowed on the entire festival grounds. This includes, but is not limited to, drugs and intoxicants, glass bottles of any kind and form, hookahs with glass bowls, other glass containers, animals/pets, weapons of any kind (including technical devices), professional photo, film, video cameras, and tape recorders, drones, torches, pyrotechnic items, laser pointers, generators, and car batteries, alcohol, gasoline or other flammable liquids, gas cartridges with more than 450g of gas, dry ice, sparklers, sky lanterns, vuvuzelas, megaphones, commercial, political, or religious items of any kind, including banners, signs, symbols, or leaflets, tents for more than 5 people, furniture, and items identifiable as bulky waste.
2. Additionally, plastic containers and cans (containers of any kind, including hydration backpacks) are prohibited on the festival grounds of Open Beatz, unless they are used by the Organizer or vendors authorized by the Organizer for the distribution of food and beverages.
3. Security checks (including body and bag searches) will be conducted at the entrance by the Organizer's security staff. The security staff is authorized to carry out body and bag searches. The Visitor agrees to this. Visitors must comply with the instructions of the security staff. The Organizer reserves the right to immediately remove a visitor from the event grounds if these instructions are not followed. In this case, no refund of the admission price will be granted.
4. The Organizer is entitled to temporarily confiscate and take possession of prohibited items as per § 8 Nos. 1 and 2, and to hand them over to public authorities or the police. The Organizer explicitly points out that it is not possible to retrieve items from disposal containers. Prohibited items may not be stored in lockers. There is no entitlement to a refund of the admission fee.
5. A subsequent inability of the Visitor to attend the event does not entitle them to a refund of the admission price.

Photography and Filming
1. The house rules are exercised by the Organizer or by third parties appointed by them. The festival grounds regulations, camping regulations, and parking regulations apply on the festival grounds. The instructions of the Organizer's staff must be followed.
2. Visitors are particularly prohibited from:
- Bringing prohibited items as defined in § 8.
- Using physical violence against other visitors, the Organizer's staff, or any third parties;
- Throwing objects onto the stages, at the Organizer's staff, or other visitors;
- Urinating or defecating outside of the designated toilets;
- Painting, spraying, or dirtying structures, walls, objects, etc.;
- Engaging in commercial trade, marketing actions, or advertising activities without prior written consent from the Organizer. Advertising activities of any kind, such as promoting a product, service, company, or brand, as well as placing decorations or other items, are generally prohibited on the entire festival grounds;
- Entering areas and rooms not accessible to visitors, and climbing on stages, tents, scaffolding, or similar structures;
- Engaging in so-called stage diving, crowd surfing, or moshing;
- Making homophobic, sexist, racist, or otherwise dehumanizing statements.
3. Photography for private use is permitted. The privacy rights of third parties must always be respected. Audio, film, digital, and video recordings, even for private use, are generally prohibited. The bringing of professional tape recorders, professional photo, film, video, and digital cameras, as well as drones, is not allowed. Misuse will be prosecuted criminally if there is a reasonable suspicion of a criminal offense. Simple digital cameras without interchangeable lenses and GoPros (no professional equipment, no film cameras) are permitted.
4. Visitors who violate the above code of conduct or other behavioral requirements may be removed from the festival grounds by the Organizer and banned from entry. If a visitor commits a criminal offense at the Open Beatz Festival (e.g., drug trafficking, assault, theft, or sexual coercion), the visitor will be immediately removed from the festival grounds without warning, and the matter will be reported to law enforcement authorities.
5. If any of the aforementioned important reasons apply and the Visitor is removed from the event location, the ticket becomes invalid; the admission price will not be refunded. A Visitor who culpably violates these Terms and Conditions, the festival regulations, the camping regulations, or the parking regulations is obligated to compensate the Organizer for any damage caused to the Organizer as a result.
§ 10 Youth Protection
The provisions of the Youth Protection Act in public spaces apply to the entire festival grounds.
§ 11 Health Impairment Due to Noise

The Visitor is aware that at Open Beatz, particularly in front of the stages, there is a high level of sound, and there is a risk of potential health damage, especially hearing damage. The Organizer ensures, through suitable technical equipment and volume limitation, that the Visitor does not suffer harm from the sound level of the performances. Regardless, it is strongly recommended to use earplugs, particularly when staying near speaker boxes, and to choose a spot in front of the respective stages that is conducive to the Visitor's individual hearing preferences.
§ 12 Collection of Deposits
The professional collection of deposit bottles is strictly prohibited on the entire festival grounds and will be prosecuted criminally if there is reasonable suspicion of a criminal offense.
§ 13 Final Provisions
1. Any changes or additions to the respective contract require written form to be effective.
2. If one or more provisions of these Terms and Conditions are wholly or partially invalid, the validity of the remaining provisions shall not be affected.

II. Special Provisions for the Use of the Parking Lot
The following special provisions are recognized as part of the concluded contract, just like the provisions in Section I.
§ 1 General Provisions
1. Empire Event & Support exercises the house rules on the parking lots as a representative of the Organizer.
2. The parking lot is exclusively available for visitors and employees of the Organizer.
3. Only vehicles approved for public traffic may be parked on the parking lot; particularly modified (e.g., lowered) vehicles are excluded.
4.The Visitor is required to comply with the parking regulations.
5. Overnight stays in vehicles on the parking lots are strictly prohibited.
6. Arrival at the festival grounds and parking is at the Visitor's own risk. For environmental reasons, the use of public transport is highly recommended.
§ 2 Parking Lot Specifics
1. The Visitor is aware that the provided parking area is a natural, minimally treated meadow. Any claims for damages caused by driving on the paths and parking spaces are excluded.
2. The Visitor is aware that extreme weather conditions may cause issues with arrival and departure to/from the parking spaces. No guarantee is given for trouble-free access. Additionally, at night or in darkness, limited lighting may be available. The Visitor is responsible for informing their passengers.
§ 3 Vehicle Parking
1. If no specific parking space is assigned by the Organizer or their staff, the Visitor can choose a free, non-reserved parking space, following the guidelines set by the parking facilities.
2. The Visitor must park their vehicle in a marked space, ensuring that unhindered entry and exit are possible for neighboring spaces. If necessary, a different spot should be chosen.
3. If the Visitor does not follow the regulation, the Organizer is entitled to reposition the incorrectly parked vehicle at the Visitor's expense or, if necessary, remove the vehicle from the parking lot.
4. The parking lot and its facilities must be used responsibly and properly. Any damages must be repaired at the Visitor's expense. Parking vehicles with leaking fuel tanks or pipes is prohibited.
5. The Visitor must observe due caution when entering and exiting, even if the Organizer's staff provides assistance.
6. The parked vehicle must be locked and properly secured in accordance with traffic norms.
7. Only vehicles with a maximum permissible total weight of up to 3.5 tons, including trailers, may be parked in the designated parking areas.
§ 4 Security Personnel
The security personnel is responsible for guidance and checking access rights, not for vehicle surveillance.
§ 5 Applicability of Road Traffic Regulations (StVO) and Other Restrictions
The StVO applies to the entire festival grounds, and vehicles must only drive at walking speed. In addition to other restrictions, the following are prohibited in the parking lot:
a. Leaving the designated driving lanes for shortcuts;
b. Storing any items;
c. Unnecessarily revving or testing engines;
d. Parking vehicles with leaking fuel tanks or carburetors;
e. Parking non-approved vehicles;
f. Cleaning vehicles or performing repairs.
2. The parking lot is cleaned by the Organizer, but any contamination caused by the Visitor must be immediately cleaned by the Visitor. Otherwise, the Organizer may remove the contamination at the Visitor's expense.
3. The Organizer's staff is authorized and required to ensure compliance with the parking regulations. Their instructions must be followed.
§ 6 Removal and Disposal of Vehicles
The Organizer may, at the Visitor's expense and risk, have the vehicle towed from the parking lot if:
a. The agreed parking time is exceeded without a special arrangement;
b. The vehicle contaminates the parking lot or threatens its operation due to leaking fuel tanks, carburetors, or other defects;
c. The vehicle is not registered or is impounded by the police during the parking period.
2. All associated costs are borne by the Visitor.
III. Camping Area Provisions
§ 1 Camping Regulations
The Visitor acknowledges the camping area regulations and agrees to abide by them.
§ 2 Arrival and Departure Times
1. A booked camping space is available from 10:00 AM on the day of arrival. The entire camping area will not open at once but will be opened in sections as needed.
2. Wild camping is prohibited and will be pursued by authorities.
3. Environmental protection and principles of waste reduction and proper disposal must be observed.
4. The unauthorized creation of fire pits on camping or parking areas is prohibited due to the risk of fire.
5. The camping space must be vacated by 3:00 PM on the day of departure. Late departures may incur an additional charge.
§ 3 Stay/Visitors
1. The camping area is to be used only by the registered persons. Visitors must be registered before entering the camping area.
2. The camping space may only be occupied with regular camping equipment. Additional equipment requires approval from the Organizer.

Nature Conservation
1. The environment and nature must be protected. Consideration for flora and fauna is a top priority. Therefore, generators are not allowed, and their use is prohibited by law. The introduction of harmful substances into the ground is strictly prohibited.
2. The creation of boundaries (e.g., ditches) or other holes (e.g., for cooling) in the camping areas is prohibited.
3. Gas cooking devices must be in perfect working condition and comply with German DIN standards. Only gas cartridges up to a maximum of 450g may be used. Open flames and campfires are prohibited.
4. Barbecuing is allowed with small grills. Grilling may be prohibited during storms or adverse weather for safety reasons. In the event of a fire, the security service must be notified immediately, even if the fire is extinguished. The use of spirits, gasoline, or other flammable liquids is prohibited. Only commercially available charcoal lighters should be used according to the instructions. The grill must never be left unattended while burning or cooling. It is prohibited to dump used charcoal on the grass.
5. At the ticket collection points, visitors will receive one trash bag each. The waste deposit paid when purchasing the festival ticket will be refunded to the visitors at the waste stations during the opening hours announced on-site and at www.openbeatz.de, upon the return of the filled bags and the waste deposit token. During the event, waste must be disposed of in the designated bins and containers at the provided waste collection points. Additional trash bags will be distributed free of charge by the security staff to maintain cleanliness.
§ 5 Unauthorized Access
Persons found on the enclosed camping area without authorization will be reported for fraud (§ 265a StGB) and trespassing (§ 123 StGB), provided there is a reasonable suspicion of a criminal offense.
IV. Special Provisions for the Use of Lockers ("Locker")
§ 1 Locker Usage
1. Lockers can only be used during the Open Beatz Festival opening hours. Usage outside these hours is not allowed.
2. The lockers are locked using a code or key, which the Visitor will receive from the locker staff.
3. The Organizer is entitled to open the locker in case of imminent danger, including the reasonable suspicion that prohibited items are stored inside the locker, as per § 8 of these Terms and Conditions. If necessary, the Organizer will involve the police.
4. After the agreed usage period ends, the locker must be emptied completely.
5. Items left in the locker after the agreed usage period will be treated as lost property. They will be inventoried by the Organizer and handed over to the local lost and found office in Herzogenaurach. The Visitor may retrieve them there according to the general procedures.
